Koromo Heritage reserves the continuous right, to at any time, to modify, alter, or update these Terms of Use, and you the user or buyer agree to be bound by such modifications, alterations, or updates. The user will not be advised by Koromo Heritage of any such modifications, alterations or updates and you are responsible for periodically checking these Terms of Use for such. 

The warranties provided by you as the user of the Koromo Heritage web site are:

1. That you have the legal capacity to enter into a legally binding contract and that you are over the age of 18 years;
2. All or any of the information you provide on this website is correct, complete and current; not misleading or deceptive or likely to mislead or deceive; and free from any programming bugs or computer viruses, faults or errors;
3. All username and password information required by you to access the Koromo Heritage web site shall be maintained and kept secret and confidential by you, and in the event that such information is lost, stolen or compromised in any other way you shall immediately notify Koromo Heritage;
4. At no time or in no way whatsoever shall you impersonate any other person or allow any other person to impersonate you or make use of your username or password;
5. You will ensure compliance with all the applicable laws in relation to any transactions entered into on this web site and you will not use this web site for any fraudulent, illegal or unethical purpose; and
6. That the use of this web site by any other person is not impeded by you in any manner or way.

Pricing Error

In the event that a product is erroneously listed at an incorrect price due to any reason whatsoever, including but not limited to error in pricing information from a supplier or vendor and/or typographical error, Koromo Heritage reserves the right to refuse or cancel any orders placed for the product listed at the incorrect price. Koromo Heritage also retains the right to refuse or cancel any such orders whether the order has been confirmed and even in the event that your credit card has been charged or your PayPal account debited.  Koromo Heritage shall as soon as practicable issue a credit to the account used for payment for any purchase or order that has been cancelled by Koromo Heritage.

Acceptance of Order

Koromo Heritage reserves the right to limit an order quantity on any item and/or refuse service to any buyer. Koromo Heritage may require you to verify your information prior to the acceptance of any order. The receipt of an order confirmation by email does not constitute the acceptance of an order or a confirmation of an offer to sell.

Retention of Title and Delivery Risk

Until such time that all monies due to Koromo Heritage have been paid in full, the products and any other goods delivered by Koromo Heritage to the buyer shall remain the sole and absolute property of Koromo Heritage as the legal and equitable owner, but shall be at the customer's risk from the time of delivery to it.

Delivery

All orders with a shipping fee will be automatically sent with the freight charged at cost irrespective of whether an estimated shipping fee was higher or lower than the actual cost calculated in the Koromo Heritage online store shopping cart and checkout.
Where large items and/or international orders incur higher shipping fees; for such orders the shipping costs will be calculated and advised for your approval prior to the order being processed.

The indication of a product being 'in stock' does not guarantee that the product is immediately available for shipping. Koromo Heritage uses other channels to market and as such these also bear on available stock.

Some of Koromo Heritage's products are made to order. These products will not be produced until such time payment has been received from the buyer. The production period for such items varies according to the item ordered and purchased, and is generally up to 28 days. Overall lead time from receipt of payment to goods being shipped is up to 28 days for all items purchased.

From time to time some of Koromo Heritage's products are able to be back ordered. The production period for such items is not guaranteed and can be up to 12 months from the date of order and purchase. Customers should contact Koromo Heritage for items that are able to be back ordered.

Once an item is purchased and is available for delivery to the purchaser, delivery periods are estimated to be as follows:

Orders within Australia please allow for 4-14 working days for delivery.
International orders please allow 7-45 days for delivery.

Regional Model Variation

It is important to note that models may differ from region to region or country to country and that some parts fitting a particular model may not be suitable for the same model in another country. Whilst all endeavours have been made to capture such variations, Koromo Heritage does not warrant nor guarantee the accuracy of model variation indicated against any item and the buyer must assure themselves that all ordered parts suit their make, model and region.

Limitation on Liability

In no way or manner whatsoever will Koromo Heritage be liable for any direct, indirect, special, punitive, incidental, exemplary or consequential damages, or any damages whatsoever, even if Koromo Heritage has been previously advised of the possibility of such damages, whether in an action under contract, negligence, or otherwise, arising out of or in connection with the use, inability to use, or performance of the information, services, products, and materials available from this site. Because some jurisdictions do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to you. If any law prohibits the exclusion of any liability, condition or warranty referred to in the Terms of Use, such condition or warranty shall be deemed to be included in the Terms of Use, and Koromo Heritage's liability will be limited, at the option of Koromo Heritage, to one or more of the following:
if the breach relates to goods:
the replacement of the goods or the supply of equivalent goods;
the payment of the cost of replacing the goods or of acquiring equivalent goods;
or
the repair of the goods

if the breach relates to services:
the supplying of the services again; or
the payment of the cost of having the services supplied again.

Third party products and services

From time to time, third parties ('Merchants') may offer their products / services on this site ('third party products').  You acknowledge and agree that insofar as third party products are offered on or via this web site by a Merchant: the information published on this web site about the third party products are provided by Merchants. Koromo Heritage is not responsible for the information published by the Merchants and simply acts as a medium for the publication of the information; furthermore, Koromo Heritage does not;

1. Act as an agent or broker of the Merchants;
2. Act as your agent or broker in relation to the purchase or possible purchase of third party products;
3. Arrange contracts between the Merchants and you and any agreement to buy any third party products is an agreement between the Merchant and you;
4. Provide advice to you in relation to the third party products;
5. Provide any warranties or guarantees in relation to the third party products and will not be liable to you or any third party for any fault, failure, wrong or default of a Merchant; and
6. Koromo Heritage will not be responsible for the resolution of any dispute in relation to any agreement formed between a Merchant and you.

From time to time Koromo Heritage's web site may have links to other sites on the Internet that are owned and operated by third party vendors and other third parties ('external sites'). This includes the Services Directory on this web site. You the user agrees that Koromo Heritage is not responsible for the availability of, or the content located on or through, any external site. You should contact the site administrator or Webmaster for those external sites if you have any concerns regarding such links or the content located on such external sites.

Governing Law

The Terms of Use and the transactions contemplated by them are governed by the laws of the State of Queensland, Australia and you hereby irrevocably submit to the exclusive jurisdiction of the courts in that State.

Entire Agreement

The Terms of Use, Disclaimers, Privacy Policy and the Warranty and Returns Policy constitute the entire agreement between the user and Koromo Heritage.

Applicability

This Warranty, Return and Refunds Policy only applies to products sold by Koromo Heritage and its approved retailers.

This Warranty, Return and Refund Policy does not apply to third party products sold by Merchants (refer also to Terms of Use). Such Merchants are responsible for all faults, returns and warranties relating to third party products purchased on this site and therefore, you should contact the Merchant directly in relation to such third party products.

Commitment

We're committed to providing the best customer experience possible and we endeavour to make Returns as simple and as easy as practicable. Koromo Heritage is happy to refund or replace any defective item and most non-defective items.

Products may not be returned to Koromo Heritage due regional model variations.

Typographical Errors

In the event that an item(s) is listed at an incorrect price or with incorrect information, Koromo Heritage reserves the right to withdraw that item(s) from sale, and to refuse or cancel orders. Koromo Heritage will make all reasonable effort to contact the customer using the details provided by the customer.

Guarantee

The workmanship of Koromo Heritage products is guaranteed. If you believe you have received a defective or damaged product and wish to the return the product for an exchange or refund, please make contact via the Contact form on the Koromo Heritage web site.

Change of Mind

Generally, as our products are mostly 'made to order' Koromo Heritage does not issue a refund simply on the basis that the customer has decided to change their mind about their purchase. This is due to resources being committed to your order at the time of ordering.

If you decide to change your mind regarding your purchase after payment has been made and for any reason whatsoever please contact Koromo Heritage via the Contact form on our website.

If you decide to change your mind regarding your purchase after receipt of the goods do not return the goods to Koromo Heritage until such time that Koromo Heritage has agreed to have the goods returned.

Delays beyond the Delivery Period

Please see Delivery on our Terms and Conditions page. 

Generally, as our products are mostly 'made to order' Koromo Heritage does not issue a refund simply on the basis that the products purchased have not been shipped within the 28day delivery period. This is due to resources being committed to your order at the time of ordering.

Returns Process

Within 14 days of having received your order, you may return Koromo Heritage products that meet each of the following criteria:

1. Have the original invoice attached
2. Are in their original packaging.
3. Have original manufacturer information and/or any other form of supplied literature or software
4. Have not been used, installed, or disassembled in any manner whatsoever
5. Are not damaged due to incorrect installation
6. All supplied parts and items are in the original packaging and do not have missing parts, hardware or instructions
7. Were not custom made (see 'made to order' in Terms of Use) or specifically ordered in and/or sourced through a vendor nominated by the buyer.

If you have chosen to return your purchased product you must advise Koromo Heritage via the Returns form found at the footer of our Shop area [insert link]. If you do not complete this form and you return a product to Koromo Heritage, then Koromo Heritage takes no responsibility whatsoever for the replacement or refund for such purchase, nor the return to you of the originally purchased item.

If you have purchased direct from Koromo Heritage you must return your product direct to Koromo Heritage. If you have purchased from a Koromo Heritage approved retailer you must return your product to the same Koromo Heritage approved retailer.

Refunds

Once we have received your return, conducted an inspection of the return, and verified that your return meets the above guidelines, a full refund will be issued. All applicable sales taxes will be refunded. The cost of shipping will be credited only in those instances that the return is a result of our error.

We will issue a full refund for any returned products when your return meets the above requirements. The cost of shipping will be credited only in those instances where the return is a result of our error (i.e. Koromo Heritage shipped an incorrect product).

Where a customer is entitled to a refund, Koromo Heritage will refund such monies using the same method (excluding cash payment) through which the customer's purchase payment was received by Koromo Heritage. Where the original purchase payment method was cash payment Koromo Heritage will issue a refund only by bank transfer.

Reproduction Parts:

Our reproduction parts ('REPRO') are a part that has been independently manufactured in an attempt to meet the original equipment manufacturer's ('OEM') specifications by a third party manufacturer for a part no longer produced by the OEM.
Due to changes in production techniques and materials used, departures from the OEM's specification are common. While some reproduction parts retailed through Koromo Heritage may be almost indistinguishable from the original part, our products are 'close imitations' and the buyer must before purchase assure themselves that the product is suitable for their purchase and that it can be fitted to the vehicle for which they have purchased it.
Returns or refunds claimed due to claimed discrepancy in production detail, finish or fitment are not accepted by Koromo Heritage. Specifications subject to change without notice.

New Old Stock:

Our New Old Stock parts ('NOS') are a part that as the name implies were manufactured by the original OEM and have been held in stock by a third party. NOS parts are by their very nature aged and have sat in stock for up to 50 years. By virtue of this fact and their nature, Koromo Heritage cannot guarantee the quality nor the consistency of quality of these parts.
The buyer must assure themselves that the quality of a NOS part will be acceptable to themselves and on this basis Koromo Heritage does not accept returns or refunds for these reasons.
